This Privacy Policy describes the personal information Fran's Chocolates, Ltd. and its affiliates (collectively, “FCL”, “we”, “our”, or “us”) collects when you use the FCL website at www.frans.com (the “Website”), how we use this information, with whom we share it, and the choices you have in connection with this.

Through your use of the Website, FCL will collect personal information from you directly and automatically as outlined below.

A. Information Collected From You

As you use the Website, FCL will collect personal information when you:

  • Apply for employment: When you apply for employment with FCL, we collect your identifiers (name, email address, telephone number, physical address) and your professional information (resume, cover letter, educational history, employment history). We use this personal information to assess your application, to communicate with you, and as necessary to comply with the law.
  • Book an event or tasting: If you are interested in booking an event or tasting at FCL, we will collect your identifiers (name, email address) and the details of your booking request. We use this personal information to finalize your booking and to communicate with you.
  • Contact us: When you contact us with a question or inquiry, we collect your identifiers (name and email address) and any other information you choose to include in your correspondence. We use this personal information to respond to your questions or inquiries, troubleshoot where necessary, and address any issues you may have.
  • Create an account: When you create a FCL account, we will collect your email address and selected username and password. We use this personal information to create and maintain your account, communicate with you, and facilitate your access to the account features.
  • Join our mailing list: If you subscribe to our mailing list, we will collect your email address to facilitate your request to receive news and special offers from FCL.
  • Make a purchase: When you make a purchase, we will collect your payment information (card number, expiration date, and CVV) and identifiers (name, physical address, email address). We use this personal information to process your payment and to fulfil and manage your purchase. Please note our payment processor collects and processes this personal information directly on our behalf and FCL only maintains historical payment information.

FCL may also use your personal information collected for the above purposes to efficiently maintain our business, to comply with the law, and for other limited circumstances as described in INFORMATION SHARING.

In addition to the personal information you provide, FCL also collects information via cookies as you use the Website. This information includes your:

We do not combine the information collected by Google Analytics with personally identifiable information. Google will use and share the information collected through Google Analytics in accordance with its Terms of Use and Privacy Policy. To opt-out, you can download the Google Analytics opt-out browser add-on. 

To conduct online advertising, we use Google Ads. We use Google Ads to deliver advertisements to you and to track whether you have interacted with an advertisement we have placed elsewhere on the internet. To do this, Google Ads stores a conversion tracking cookie on your device when you click on our advertisement. The information obtained through the cookie is used to generate statistics and allows us to see the total number of users who clicked on our advertisements. We also use Google Ads to present to users of our Website advertisements across the internet and within the Google advertising network based on their visits to our Website. INFORMATION SHARING

FCL will the personal information identified in this Privacy Policy in the following instances:

  • Within FCL: Where necessary, FCL will share your personal information within FCL to efficiently carry out business and to the extent permitted by law.
  • With service providers: FCL will share your personal information with service providers that perform services on FCL’s behalf in connection with the website. These service providers include our IT support, payment processor, email provider, and shipping provider.
  • In the event of a corporate reorganization: In the event that FCL enters into, or intends to enter into, a transaction that alters the structure of FCL, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our assets, FCL would share your personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. FCL would also share your personal information with third parties if FCL undergoes bankruptcy or liquidation, in the course of such proceedings.

NEVADA RESIDENTS 

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. FCL does not currently sell any of your personal information under Nevada law, nor does FCL plan to do so in the future. However, you can submit a request to opt-out of future sales by contacting FCL at orders@frans.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.

 

CORRECT OR VIEW YOUR PERSONAL INFORMATION 

You can access your FCL account to correct or view certain personal information of yours in our possession and which is associated with your account.

 

MARKETING EMAILS 

You may opt-out of receiving marketing emails from FCL by clicking the “unsubscribe” link provided with each email. Please note that FCL will continue to send you emails necessary to the Website, your account, your purchase, or any assistance you request.

 

DO NOT TRACK

We do not support Do Not Track (DNT).

FCL implements and maintains reasonable security measures, including access controls and encryption, to protect the personal information FCL collects and maintains. However, no security measure or modality of data transmission over the Internet is 100% secure and FCL is unable to guarantee the absolute security of the information collected from you.

 

AGE RESTRICTION 

The Website is not intended for individuals under the age of eighteen (18).

FCL may change this Privacy Policy from time to time. We will post the changes to this page and indicate the date the changes go into effect.
